Texas Family Law - Best Interest of the Child Standard

In Texas, Family law cases revolve around a very important principle. The best interest of the child is a principle used by judges, jurors, and court representatives in the issuing of the binding orders that dictate the rights and duties of parents, the residence of the child and geographic restriction if necessary, the possession and access, the child support, and any other issue involving children.

Child Custody – What Does the Court Look at?

The Court looks at the needs of the child over any other interest. So, one parent may be very popular with the children and extremely desired, but that parent may also let the children do as they please and lacks any support in ensuring they attend and meaningfully participate in school. In cases like that, the Court looks not at what the children want, but what is best. 

A person may have been a terrible spouse. They may have cheated and been a terrible martial partner, however it was, the Court does not care how one feels about their ex. The Court will ensure the children have frequent access to the other parent as it is in their best interest to know that parent loves them and for that parent to exercise their rights and duties. 

Which Parent Makes the Best Decision?

One parent may be the one that pulls the child out of football because the child comes dangerously close to failing. And that one parent may be the one that ensures all homework is completed, projects are done timely, nutritious food is prepared, and that the children are given activities that contribute to their development.
