Wrongful Death

At The Barrera Law Firm, we can help families through this difficult time by providing the appropriate legal action in this matter. Losing a loved one is not only emotionally trying but financially stressful, especially if the deceased provided for the family.

According to Texas Law, there are circumstances that would make a wrongful death the responsibility of another and make them liable for damages.

A person is liable for damages arising from an injury that causes an individual’s death if the injury was caused by the person’s or his agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness, or default.

A person is liable for damages arising from an injury that causes an individual’s death if the person is a proprietor, owner, charterer, or hirer of an industrial or public utility plant or of a railroad, street railway, steamboat, stagecoach, or other vehicles for the transportation of goods or passengers. And the injury was caused by the person’s or his agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness, or default.

And the injury was caused by the person’s wrongful act, neglect, carelessness, unskillfulness, or default. Or the person’s servant’s or agent’s wrongful act, neglect, carelessness, unfitness, unskillfulness, or default.

Overwhelming Financial Burden

No words can be spoken that will express the loss of a loved one or come close to making the feeling of loss any better. When losing a loved one because of an unexpected accident, one that could have been prevented had another party not been negligent, the feeling of loss can often be accompanied by frustration, anger, confusion, and more. On top of the emotional pain and trauma losing a loved one can bring, a death can bring an overwhelming financial burden to loved ones with the costs of lost wages, medical bills, the funeral, and other expenses to deal with. While holding the negligent parties financially responsible for the wrongful death of your loved one may not take away the pain or sense of loss you feel, it has the potential to at least help ease the financial strain you may be taking as a result of that loss.
