Texas law provides grounds in which stepparents may apply to adopt a child.
Sometimes it is necessary to terminate the rights of a biological parent in order to do so. In order to terminate the rights of a biological parent, there must be grounds for such termination including, but not limited to, failure to pay child support for a year, abandonment, or agreement to voluntarily give up parental rights.
The Court may appoint an attorney for the child in order to ensure that everything is done properly, and that the adoption is in the best interest of the child. Both the child’s biological parent and the stepparent will need to submit to a criminal background check, and they must also be married.
