Judges don’t like splitting kids up, but when there is a child over 12 the Court may confer with that child in order to determine which residence the child prefers. Along with that the court will also need evidence regarding the best interest of the child.
Some children are doing great. Some children are making great grades. They’re doing great in extra-curriculars, and each parent is doing what they’re supposed to be doing. In other cases there is the difference between if there is a non-disciplinary parent or a parent who instills discipline. Courts like parents that are on top of schools, that make tough decisions, they like parents that make sure things are done for the best interests of kids.
When you get older teenagers sometimes courts look a little more as to where their preferences are. For example they may already be driving, or they’re already on their way out aging out.
